Despite nobody calling Smyly to the scene, Smyly confronted Atkinson on the grounds that Smyly saw a "no trespassing" sign and thought Atkinson, who is Black, looked suspicious despite Atkinson being on his own property doing a service for his school's dorm. Smyly resigned and will be paid into 2020 by Boulder Police Department (which refused to fire him) after he leaves
