One of the most frustrating situations I have encountered over the last few years is the situation where individuals with big, unpayable debts were led to believe that there was an easy solution to the problem. Some of these solutions involved schemes such as the Kilkenny trust, the citing of ancient laws which had little or no validity today, the quotation of Brehon law, technical defences, and so forth.
Some debtors fell for what appeared to be appealing, simplistic solutions. But when the went to court with these arguments they invariably ended up owing the money along with increased costs of canvassing arguments that were bound to fail and not recognised in law.
